The City Council of Salt Lake City, Utah, met in Work Session on Tuesday, June 14, 2022. 

The following Council Members were present:

Council Member Dugan welcomed everyone to the meeting.
Mayor Mendenhall presented the following:
  • Current COVID-19 hospitalization, vaccination, and case identification statistics
  • Current COVID-19 wastewater data indicated no spikes incoming
  • Weekly lawn watering guide and recommendations 
Andrew Johnston presented the following:
  • Homeless Resource Center and overflow occupancy rates
  • Rapid intervention team providing outreach at 7 targeted camps 
  • Resource fair held Friday June 10, 2022
  • Kayak Court happening on June 17, 2022 at the Jordan River

Fiscal Year 2022-23 Budget: Unresolved Issues Follow-up ~ 3:00 p.m.

Minutes:
Jennifer Bruno, Ben Luedtke, Allison Rowland, Sam Owen, Sylvia Richards, and Council Members discussed the following items:
  • Motions and language provided in the motion sheet that would be used during the City Council formal meeting.
  • Council members considered changes to the following legislative intents listed in the motion sheet:
    • Adding an intent asking the Administration and Attorney’s Office to replace the current ordinance governing donations to the City (provide a more streamlined one)
    • Adding an intent to establish rotating audits of each City department to identity efficiency improvements within the City
    • Item K – added Department of Economic Development for role clarity
    • Item J – changed the intent to be inclusive of making water recommendations for current projects
  • Motions and language provided in the motion sheet that would be used during the Redevelopment Agency formal meeting.
  • Council Members considered changes to the following legislative intents:
    • Item B – removing part of intent to be less overbearing on developers
    • Item C – changing language to provide increased flexibility for the Administration

Straw Poll: Support for adding a legislative intent for rotating audits. Supported, Council Members Petro-Eschler, Puy, Wharton, Valdemoros, Mano, and Dugan were in favor; Council Member Fowler was not in favor. 
Straw Poll: Support for changing legislative intent K to include Department of Economic Development. Supported unanimously by all Council Members present.
Straw Poll: Support for adding inclusion of water saving opportunities in current projects to legislative intent J. Supported unanimously by all Council Members present.
Straw Poll: Support for changing language of legislative intent B to be less overbearing on developers. Supported unanimously by all Council Members present.
Straw Poll: Support for changing language of legislative intent C to provide increased flexibility for the Administration. Supported unanimously by all Council Members present.
 
3.
Fiscal Year 2022-23 Budget: Capital Improvement Program Overview Follow-up ~ 3:30 p.m.

The Council will receive a follow-up briefing about the City's Capital Improvement Program (CIP) which involves the construction, purchase or renovation of buildings, parks, streets or other city-owned physical structures. Generally, projects have a useful life of at least five years and cost $50,000 or more. The Council approves debt service and overall CIP funding in the annual budget process, while project-specific funding is approved by September 1 of the same year.

Minutes:
Ben Luedtke introduced the following changes made to the Capital Improvement Plan (CIP) sheet that lists all of the Capital project proposals. 
  • Added a column that clarifies eligibility for American Rescue Plan Act (ARPA) funds
  • Added a column that clarifies impact fee eligibility for projects in the sales tax bond and General Obligation (GO) bond 
Ben then explained the legal deadlines for the following items
  • The sales tax bond has no deadline
  • The GO bond must be complete 75 days before the election, meaning the August 16, 2022 meeting would be the last regularly scheduled Council meeting to make a decision
  • The annual deadline for CIP is September 1, also meaning the August 16, 2022 meeting would be the last regularly scheduled Council meeting to make a decision

Council Member Fowler requested for the Council to table in-depth changes to the bonds for a future Council meeting due to the large volume of budget discussion still needed. 
Council Members Petro-Eschler and Valdemoros clarified that tabling this discussion wouldn’t restrict the Council’s ability to make changes to project funding.
Council Member Wharton stressed the importance of finalizing the GO bond as quickly as possible to ensure that citizens have enough time to learn about the bond before voting on it.
Council Members Fowler, Petro-Eschler, and Puy recognized Council Member Wharton’s point and proposed meeting about potential changes in the coming weeks because of the interconnectedness of the bonds. 

Council Member Mano asked for more information on Glendale Park and Allen Park; Specifically, what is the minimum amount of money needed to make progress in Glendale Park if the GO bond isn’t approved and what are the future plans for Allen Park.
Ben explained that the Council previously appropriated funding to Glendale Park, so that project is already moving forward. They also explained that the Council funded an activation and historic reuse plan for Allen Park, so staff will look into bringing that plan back for a midpoint check in.

Council Member Valdemoros noted that a lot of projects listed in the CIP sheets are eligible for ARPA funds; Ben clarified that projects that are listed as eligible would still need to be evaluated to ensure that they could meet deadlines associated with ARPA.

5.
Informational: Harvard Presentation ~ 4:50 p.m.

The Council will receive a briefing from the Harvard Kennedy School about their findings on a project in the Ballpark District. Scope of the student project was limited to Public-Private Partnership (PPP) as a tool to finance urban redevelopment.  Smith’s Ballpark and the surrounding neighborhood were the geographic boundaries of the study.  This project provided a template to assess the viability of PPPs following the project, players, and process structural framework.

Minutes:
Andrew Reed, Mary Beth Thompson, and Adam Zitello (Harvard Kennedy School student) presented research conducted by Harvard Kennedy School students regarding the utilization of Public-private Partnerships (PPP) in the Ballpark Area. Their presentation outlined the guiding principles and methodology of the research, the different dimensions that would make the a PPP successful, and the various key considerations that would need to be considered before utilizing a PPP (site selection, land use, and secondary effects). 

Virginia Carefoote (Finance Department Fellow) discussed her plan to utilize the research to develop a financial model that will be useful for future City projects. 

Council Member Mano expressed appreciation for the research and emphasized the high potential of the Ballpark Area.

Council Member Dugan and Fowler asked about similar projects in other cities and how to improve on their approaches. 
Virginia explained that the outcomes in other cities have been mixed, so the model being developed looks to utilize the best outcomes.

  • Registration for the National Conference on ending homelessness was full, so interested Council Members will be put on waiting list.
  • Council Members were invited to meet with Andrew Johnston about Homelessness issues.

Tentative Closed Session
 
The Council will consider a motion to enter into Closed Session. A closed meeting described under Section 52-4-205 may be held for specific purposes including, but not limited to:
a.     discussion of the character, professional competence, or physical or mental health of an individual;
b.     strategy sessions to discuss collective bargaining;
c.    strategy sessions to discuss pending or reasonably imminent litigation;
d.    strategy sessions to discuss the purchase, exchange, or lease of real property, including any form of a water right or water shares, if public discussion of the transaction would:
(i)    disclose the appraisal or estimated value of the property under consideration; or
(ii)     prevent the public body from completing the transaction on the best possible terms;
e.    strategy sessions to discuss the sale of real property, including any form of a water right or water shares, if:
(i) public discussion of the transaction would:
(A) disclose the appraisal or estimated value of the property under consideration; or
(B) prevent the public body from completing the transaction on the best possible terms;
(ii)     the public body previously gave public notice that the property would be offered for sale; and
(iii)     the terms of the sale are publicly disclosed before the public body approves the sale;
f.    discussion regarding deployment of security personnel, devices, or systems; and
g.     investigative proceedings regarding allegations of criminal misconduct.
A closed meeting may also be held for attorney-client matters that are privileged pursuant to Utah Code § 78B-1-137, and for other lawful purposes that satisfy the pertinent requirements of the Utah Open and Public Meetings Act.
